Terms and conditions

These terms govern your use of chairsideweb.com and any website plan you buy from ChairsideWeb ("we", "us"). Paying the first monthly invoice is acceptance of these terms.

The agreement

The agreement is made of these terms, the plan you select on the pricing page at the time of purchase, the refund and cancellation policy, and any written scope we agree by email. If they conflict, the written scope wins, then the plan, then these terms.

The service

We design, build, host, update and maintain a website for your dental group or practice on the plan you choose. What each plan includes is set out on the pricing page and forms part of this agreement. We are not a dental practice, dental group, dentist or healthcare provider. The website is a marketing and booking tool; the clinical care you deliver to your patients is entirely yours.

Domain and hosting

Both are included in your plan and neither is charged as an extra.

• Domain. One domain is included free for as long as your plan is active. We register it through Cloudflare Registrar or Spaceship, in your group's name, and you own it. If you already own a domain we point it at the new site instead and nothing changes for patients who know your current address. Renewal of the included domain is covered by your plan.
• Hosting. Your site is hosted on Cloudflare's global network, with SSL, CDN, DDoS protection and unmetered bandwidth included. There is no separate hosting bill, no SSL bill, no CDN bill and no bandwidth overage. It is inside the monthly figure and does not reappear as a line item later.

If you cancel, the domain remains yours: tell us where to transfer it and we move it at no charge. Hosting ends with the plan.

Fees and billing

Plans are billed monthly in advance at the price shown when you buy: currently $137, $297 plus AI usage, or $747 a month. Usage on the AI Engine is billed monthly in arrears at what our providers charge us. Prices are in US dollars and exclude any taxes you are required to pay. Payment is taken automatically on your renewal date from the method on file. We may change prices with 30 days written notice; the new price applies from your next billing date after the notice period.

The one-time build fee

Every plan carries a one-time build fee of $797. It is not charged when you sign up. It is invoiced after your site is live and you have confirmed you are satisfied with it, and it is due within 7 days of that invoice. If you cancel before the build starts, no build fee is charged. If you cancel after the build starts but before launch, we may invoice the proportion of the fee that reflects the work completed.

Revisions and turnaround

5 revisions a month are included in every plan, across every office in the group. A revision is a single change request of any size. Additional revisions in the same month are $20 each. We complete revisions within 2 to 5 working days of receiving everything we need from you. Unused revisions do not roll over.

Your content and our content

You are responsible for the accuracy and legality of the information you give us to publish: offices, providers, services, prices, qualifications, licenses, insurance accepted and any claims about your group. Articles we write are general information for patients and families; they are not dental or medical advice for any individual and we say so where the subject calls for it. You may ask us to correct or remove any article at any time.

Ownership

While your plan is active you have a license to use the site. Content you supply stays yours, and your domain is yours throughout. Design, code and templates we create stay ours, and we may reuse patterns across clients. On cancellation we provide an export of your content and articles within 14 days.

The AI Engine

On plans that include it, the AI receptionist, chat and messaging agents answer questions about your offices, take booking details and route requests to the right front desk. They are configured not to give dental or medical advice and to hand anything that would amount to advice, or anything that sounds urgent, to a person at your practice. You review the scripts before launch. Text messaging requires carrier registration (A2P 10DLC), which we file for you; carrier fees are passed through at cost. You are responsible for consent, opt-out and record-keeping obligations that apply to your own communications with patients.

Your responsibilities

• Give us accurate information and respond to our requests during the build.
• Own or have the right to use any logo, photograph or text you give us.
• Comply with the advertising, licensing and professional rules that apply to your practice.
• Keep a valid payment method on file and pay invoices when due.

Cancellation and notice

You may cancel at any time, but the notice period is strict because billing is automatic.

• Cancellation must be sent by email to hello@chairsideweb.com. No other channel counts.
• It must reach us at least 2 business days before your next invoice date, during business hours: 9:00 to 17:00 Central Time, Monday to Friday, excluding United States public holidays.
• A message sent outside business hours is treated as arriving at the start of the next business day. A weekend message therefore does not begin its notice period until Monday, and does not give 2 business days of notice for an invoice due Monday or Tuesday.
• With valid notice, no further invoice is raised and the service runs to the end of the month you have paid for.
• With late notice, the next invoice is charged as normal and the cancellation takes effect at the end of that month. That charge is not refunded.

We confirm every cancellation by email. Until you have that confirmation, the subscription is active.

Refunds

All sales are final. We do not refund for a change of mind or for unused service. The only refund we issue is for a duplicate or incorrect charge made by us. The full position is set out in the refund and cancellation policy, which forms part of this agreement.

Guarantees and their limits

We guarantee a Google PageSpeed score of 90+ on mobile and desktop for pages we build and host. If a page falls below that because of our work, we fix it at no charge. We guarantee that your site starts ranking for local searches in your area within 3 to 5 months of launch; if it has not, we continue the search work at no additional charge until it does. Neither guarantee covers changes you or third parties make, content you ask us to publish against our advice, or ranking for terms outside your area or services. Neither guarantee entitles you to a refund; the remedy is the corrective work described here.

Suspension and termination by us

We may suspend the site if an invoice is more than 14 days overdue, and end the agreement if it is more than 30 days overdue. We may also end the agreement, with 30 days notice and no further invoice, if we cannot serve you properly or if you ask us to publish something unlawful, misleading or a clinical claim we do not carry.

Liability

To the fullest extent the law allows, our total liability under this agreement in any 12-month period is limited to the fees you paid us in that period. We are not liable for indirect or consequential loss, lost profits, or loss arising from third-party services such as Cloudflare, domain registrars, payment processors, practice management systems or messaging carriers. Nothing here limits liability that cannot be limited by law.

General

This agreement is governed by the laws of the State of Texas, United States, and disputes are resolved in its courts. If any part of these terms is found unenforceable the rest stays in force. Notices are sent by email to the addresses each party uses in normal correspondence. Questions: hello@chairsideweb.com.
